Recent Employment law and HR changes round up – a quick reminder of what has recently changed.
1. Neonatal care leave and pay –applying from 6th April 2025 and a day 1 right, new rules will provide parents with time off where babies, that are born 6th April 2025 onwards, need neonatal care for 7 days or more during their first 28 days, providing: –
- up to 12 weeks of leave (within 68 weeks of birth); and also
- subject to eligibility (26 weeks service and earning above min threshold of £125 p/w), statutory neonatal pay at the lower of 90% of pay or £187 p/w).
2. Tips for staff – don’t forget that, from October 2024, all tips and gratuities/service charges must (without deduction) go to employees/be shared fairly between them in compliance with the codes of practice. Policies need updating.
3. Sexual Harassment – don’t forget, again, from October 2024 the duty to take reasonable steps to prevent sexual harassment of employees applies to employers and Tribunals can award up to 25% more in compensation where the employer fails to take reasonable steps as required. Policies need updating.
4. Fire and Re-hire – not so new but still worth a reminder, if you are contemplating using this, from July 2024 compensation increased where employers fail to follow the new codes of practice on Fire and Rehire. The Employment Tribunal can now increase compensation by 25% if you don’t comply when looking to terminate and re-engage employees. There are also further changes in this area too, we’ll update next month on those.
